Azzerata in Cassazione (sentenza n. 17498 del 4 luglio 2018) la tesi del Tribunale e della Corte d'Appello di Milano secondo cui sarebbe nulla, per infrazione del divieto del patto leonino, l’opzione put con la quale, in sostanza, si "garantisce" a un socio la restituzione dei suoi conferimenti nel capitale sociale. Il Tribunale di Milano si era espresso con sentenza 18833 del 30 dicembre 2011, la Corte d’appello con sentenza n. 636 del 19 febbraio 2016 (si veda Il Sole 24 Ore del 4 maggio 2016)
